     The Yamuna Par Krishi Upaj Mandi Samiti was initially constituted in the year 1979 under the provisions of the Delhi Agricultural Produce Marketing (Regulation) Act, 1976. Anaj Mandi Shahdara was its principal yard and near about half of the trans-yamuna area was the Market Area of this Committee. The main aim of regulation was to ensure orderly Marketing to Safeguard the interests of both producer/seller and consumers by eliminating malpractices like under weighments, short payments, delayed payments, unauthorized deductions, indulgence of the many middlemen etc. This regulated market ensures economic, legal and infrastructural conditions conducive to competitive Marketing so as to improve economic returns for the farmer's produce.

       As the financial conditions of the committee was not sound, the committee was revamped in December, 1992 by notifying the whole of trans-Yamuna area as market area of A.P.M.C, Shahdara and also bringing Fruit, Vegetable and fodder in the list of notified items of this committee. The entire area of N.C.T of Delhi across the Eastern Bank of Yamuna is the Market area of this committee. Vide Notification No. F(34)/2014/DAM/MR/1886 dt. 02.09.2014 the Market area of this committee has been redefined (West – Village Bhovapur, East- Village Gazipur, North – Gaushala, South – Road NH-24) for selling of Fruits & Vegetables instead of the entire area of NCT of Delhi across the Eastern Bank of Yamuna. As many as 144 commodities Fruit and Vegetable have been notified for regulation in this Market area. The principal yard of this committee is located at Fruit and Vegetable Market, Shahdara and the sub-yards are located Jheel Khuranja & Shakarpur Pusta. The Fruit & Vegetable Market, Shahdara has been shifted to a piece of land measuring 27.06 acres at Gazipur adjoining National Highway No. 24 opposite Fish Market in the June 2001. This office constructed Big Shop (384) & Small (240). The office has been allotted Big Shop (309) & small (109) to the commission agents. The allotment of balance shop is under process.

     The first Market Committee was constituted in the year 1979 but after one year it was superseded. Thereafter, an Administrator functioned in place of Market Committee up to 04.04.2002 and a new Marketing Committee was constituted vide notification No. F 8/18/99/DAM/MR/1196-1230 dated 01.4.2002 under the provisions of DAPM(R) Act, 1998 which replaced the DAPM(R) Act, 1976. The Marketing Committee has been functioning since 04.04.2002 onwards. The office of the committee has also been shifted from 4/1378, South Bhola Nath Nagar to Office Complex at Fruit and Vegetable Market, Gazipur, Delhi-96 in the October year 2001.

1% of sale proceeds is charged as levy of market fee termed as “Market Fund” to meet out all expenditure.

Grant of licence – (Under Section 80 of the DAPM (R) Act, 1998)

  1. Subject to the rules made in this behalf, a marketing committee may, after making such inquiries as it deems fit, grant or renew a licence for the use of any place in the market yard/area for their marketing of agricultural produce or for operating therein as a trader, commission agent, broker, processor, weighman, measurer, surveyor, warehouseman or in any other capacity in relation to the marketing of agricultural produce or may, after recording reasons in writing, refuse to grant or renew any such licence.

  Provided that where a marketing committee has not started functioning, the Director, subject to any rules that may be made in this behalf, may grant or renew a licence for the marketing of agricultural produce or for operating in the market yard/area as a trader, commission agent, broker, processor, weighman, measure, surveyor, warehouseman or any other capacity.

  1. A licence granted under sub-section (1),-

(a) Shall be in such form, valid for such period, and subject to such terms, conditions, restrictions and limitations as may be prescribed;

(b) Places at which weighment and delivery of agricultural produce shall be made in any market or market area and on payment of such fees as may be prescribed.

  1. If the marketing committee or the Director, as the case may be, fails to grant or renew a licence within a period of sixty days from the date of receipt of an application in that behalf, it shall be deemed that the licence has been granted or renewed, as the case may be, if such grant or renewal has not been refused by marketing committee or the Director, as the case may be, within the said period of sixty days.

Power to cancel or suspend licence – (Under Section 81 of the DAPM (R) Act, 1998)

  1. Subject to the provisions of sub-section (3), a marketing committee may for reasons to be recorded in writing, suspend or cancel a licence granted or renewed under this Chapter.

(a) if the licence had been obtained through willful misrepresentation or fraud;

(b) if the holder of the licence or any servant or any acting on his behalf with his express or implied permission commits a breach of any of the terms or conditions of the licence and/or holder of licence makes violation of the provisions of the Act, rules and bye-laws made there under;

(c) if the holder of the licence in combination with other holders of licence commits any act or refrains from carrying out his normal business in the market with the intention of willfully obstructing, suspending or stopping the marketing of agricultural produce in the market yard and /or area;

(d) if the holder of the licence has been adjudged an insolvent, and has not obtained his discharge; or

(e) if the holder of the licence is convicted his discharge; or

  1. Notwithstanding anything contained in sub-section (1) but subject to the provisions of sub-section (3), the Director may, for reasons to be recorded in writing, by order, suspend or cancel any licence granted or renewed under this Chapter.
  2. No licence shall be suspended or cancelled under this section, unless the holder thereof has been given a reasonable opportunity of showing cause against the proposed action.

Appeal – (Under Section 82 of the DAPM (R) Act, 1998)

  1. Any person aggrieved by the order –

(a) of a marketing committee, refusing to grant or renew a licence, or cancelling or suspending any licence, may prefer an appeal within 30 days to the Vice-Chairman of the Board.

(b) of the Director refusing to grant or renew a licence or cancelling or suspending any licence may prefer an appeal to the Secretary Agricultural Marketing Department of the Government within thirty days from the date on which such order is communicated to him and in such manner as may be prescribed.

  1. The Vice-Chairman of the Board, or the Secretary, Agricultural Marketing Department of the Government, as the case may be, on such appeal, make such order as he may deem just and proper.

Provided that, before dismissing an appeal, the Vice-Chairman of the Board or the Secretary, Agricultural Marketing Department of the Government, as the case may be, shall give the appellant a reasonable opportunity of being heard, and record in writing the reasons for such dismissal.
